MyAgentNavigator is a professional development and coaching platform designed for real estate professionals. The Platform provides tools, resources, and educational materials to help agents develop business strategies, improve skills, track progress, and navigate their professional growth.

MyAgentNavigator is not a real estate brokerage, does not represent buyers or sellers, and does not facilitate real estate transactions.

MyAgentNavigator does not provide legal, financial, brokerage, or tax advice. All educational materials and guidance provided through the Platform are intended solely for informational and professional development purposes.

Users remain solely responsible for their professional decisions, business practices, and compliance with licensing laws and brokerage policies.

Any fees charged by MyAgentNavigator are platform subscription or service fees only and are not connected to real estate transaction commissions.

MyAgentNavigator does not participate in, collect, or receive compensation from real estate transactions.

You must be at least 18 years old to use the Platform.

Real estate professionals are responsible for ensuring their use of the Platform complies with the policies of their brokerage, state licensing authority, and applicable regulations.

To access certain features, you may need to create an account.

MyAgentNavigator reserves the right to suspend or terminate accounts that violate these Terms.

These materials are educational only and do not guarantee business results, income, or professional success.

Users acknowledge that MyAgentNavigator makes no guarantees regarding professional performance, earnings, or business outcomes.

MyAgentNavigator does not supervise real estate professionals and is not responsible for users’ professional conduct.

MyAgentNavigator is an educational and professional development platform designed to provide training resources, business strategy guidance, productivity tools, and professional coaching content for real estate professionals. The Platform may include productivity tracking tools or benchmarking features that rely on user-submitted data.

MyAgentNavigator does not operate as a real estate brokerage, does not supervise licensed professionals, and does not provide brokerage services of any kind. The Platform does not facilitate real estate transactions, represent buyers or sellers, or participate in negotiations or contractual relationships related to real estate transactions.

All materials, training programs, and guidance available through the Platform are educational in nature and are intended solely to assist users in developing their own professional skills and business strategies.

Users remain solely responsible for their professional decisions, actions, compliance with real estate laws, brokerage policies, licensing requirements, and professional standards in their respective jurisdictions.

Use of the Platform does not create any brokerage relationship, supervisory relationship, agency relationship, partnership, joint venture, or employment relationship between MyAgentNavigator and any user.

MyAgentNavigator may provide educational materials, strategic guidance, productivity frameworks, and coaching tools intended to assist real estate professionals in developing their businesses.

However, MyAgentNavigator makes no representations, warranties, or guarantees regarding any user’s business performance, earnings, commissions, transaction volume, lead generation success, client acquisition, or overall professional results.

Any examples, case studies, testimonials, projections, or illustrative scenarios provided through the Platform are for educational purposes only and should not be interpreted as guarantees of future results.

Users acknowledge that all business decisions and outcomes remain solely their responsibility.

Real estate professionals using the Platform acknowledge and agree that they remain independent professionals operating under the supervision of their own brokerage or employing broker, as required by applicable real estate licensing laws.

Users are solely responsible for ensuring that their use of the Platform complies with their brokerage policies, state licensing laws, MLS rules, REALTOR® association standards, and all applicable federal, state, and local regulations, including but not limited to Fair Housing laws and advertising regulations.

Nothing contained in the Platform should be interpreted as overriding, replacing, or modifying the supervision and compliance responsibilities imposed by a user’s brokerage or licensing authority.

Violation of these rules may result in account suspension or termination.

By submitting content, you grant MyAgentNavigator a non-exclusive, worldwide, royalty-free license to use that content for operating and improving the Platform.

Users may not copy, reproduce, distribute, or commercially exploit any Platform content without permission.

The Platform may allow users to voluntarily connect their accounts with other real estate professionals for the purposes of professional networking, accountability, benchmarking, or friendly competition. Users may choose to make certain profile elements, productivity metrics, activity indicators, or progress tracking information visible to other users whom they select and approve.

Participation in any connection, visibility, benchmarking, leaderboard, or comparison features is entirely optional and controlled by the user. Users may choose which individuals can view their information and may modify or revoke such permissions at any time through their account settings.

Users acknowledge and agree that any data shared through these features is intended solely for professional motivation, collaboration, or friendly competition and should not be interpreted as verified performance metrics, professional rankings, or objective measures of success.

MyAgentNavigator does not verify, audit, or guarantee the accuracy of any information displayed through user profiles, progress tracking, or benchmarking features, and users remain solely responsible for the accuracy of any information they choose to share.

MyAgentNavigator is not responsible for how users interpret or use information displayed through these features and expressly disclaims any liability arising from comparisons, rankings, or competitive interactions between users.

MyAgentNavigator strives to maintain a reliable and functional Platform that allows users to access educational materials, coaching tools, progress tracking features, and other professional development resources. However, MyAgentNavigator does not guarantee that the Platform will always be available, uninterrupted, secure, or error-free.

From time to time, MyAgentNavigator may modify, update, enhance, suspend, or discontinue certain features, tools, educational materials, or services at its sole discretion and without prior notice. Such changes may include updates to training modules, coaching resources, user interface design, benchmarking tools, integrations, or other Platform functionality.

MyAgentNavigator may also perform scheduled or unscheduled maintenance, system upgrades, security updates, or technical improvements that may temporarily limit or interrupt access to the Platform. MyAgentNavigator shall not be liable for any temporary unavailability, delays, loss of data, or interruptions resulting from maintenance, system updates, technical failures, or circumstances beyond its control.

The Platform may include links to, integrations with, or connections to third-party websites, applications, services, or tools. These third-party services may include, but are not limited to, payment processors, analytics services, communication tools, educational resources, or other external platforms.

In certain circumstances, the Platform may also link to or integrate with other platforms or services operated by affiliated or related entities, including but not limited to the RE-Quest platform. Such integrations may allow users to access additional services, features, or information provided outside of the MyAgentNavigator Platform.

MyAgentNavigator does not own, operate, or control third-party services and is not responsible or liable for the content, policies, practices, availability, security, or functionality of any third-party services or platforms.

If users choose to connect their accounts to third-party services, they do so voluntarily and acknowledge that their interactions with such services are governed solely by the terms, conditions, and privacy policies of the respective third parties.

MyAgentNavigator does not process, store, or control payment information when transactions are handled through third-party payment processors. All payment processing, billing management, refunds, and related financial transactions may be handled by such third-party providers in accordance with their own policies and security standards.

Users expressly release MyAgentNavigator from any and all claims, liabilities, damages, or disputes arising from or related to the use of any third-party services, including but not limited to payment processing issues, service interruptions, data handling practices, or interactions with other external platforms.

MyAgentNavigator makes no representations or warranties regarding any third-party services and does not endorse or guarantee the reliability, security, or performance of any third-party providers.

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

MYAGENTNAVIGATOR DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

Use of the Platform and any educational materials provided is entirely at your own risk.

You agree to defend, indemnify, and hold harmless MyAgentNavigator and its officers, directors, employees, agents, affiliates, licensors, service providers, and contractors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

• your use of the Platform
• your reliance on educational materials or tools
• your professional activities as a real estate agent or business owner
• your violation of these Terms
• your violation of any law or third-party rights
• any content you submit to the Platform

MyAgentNavigator is not a party to agreements or relationships formed between users of the Platform.

MyAgentNavigator shall have no liability, responsibility, or obligation regarding such disputes, and users agree to release and hold harmless MyAgentNavigator from any matters arising from interactions between users.

Users may also discontinue use of the Platform at any time.

Upon termination, all licenses and rights granted to you under these Terms will immediately cease. Certain sections—including intellectual property, disclaimers, indemnification, and limitation of liability—will survive termination.

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your information.

By using the Platform, you acknowledge that you have read, understood, and agree to the Privacy Policy and consent to the collection and use of your information as described therein.

MyAgentNavigator complies with applicable data protection laws, including the Colorado Privacy Act (CPA) and other relevant privacy regulations.

Your continued use of the Platform following such notice constitutes your acceptance of the updated Terms.

If you do not agree with the updated Terms, you must discontinue use of the Platform.

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or relating to these Terms or the Platform shall be brought exclusively in the state or federal courts located in Denver, Colorado, and you consent to the jurisdiction and venue of such courts.

Except as provided below, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform, including the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved through binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Commercial Arbitration Rules.

For disputes involving individual consumers (as defined by applicable consumer protection laws), the AAA’s Consumer Arbitration Rules shall apply. For disputes involving licensed real estate professionals, agents, brokers, or business entities using the Platform for professional or commercial purposes, the AAA’s Commercial Arbitration Rules shall apply.

The arbitration shall be conducted in Denver, Colorado. The arbitrator’s decision shall be final and binding, except for any right of appeal provided by the Federal Arbitration Act, and judgment on the award may be entered in any court having jurisdiction.

Each party shall bear its own attorneys’ fees and costs incurred in connection with the arbitration unless otherwise provided by applicable law or awarded by the arbitrator.

Notwithstanding the foregoing, either party may seek injunctive or equitable relief in the state or federal courts located in Denver, Colorado to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights, or to address circumstances where immediate relief is necessary to prevent irreparable harm to business operations, platform security, or confidential information.

Additionally, either party may bring an individual claim in small claims court if the matter qualifies for such court’s jurisdiction and is brought on an individual (non-class, non-representative) basis.

YOU UNDERSTAND AND AGREE THAT BY ACCEPTING THESE TERMS, YOU AND MYAGENTNAVIGATOR ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION.

You and MyAgentNavigator agree that any arbitration or legal proceeding shall be conducted on an individual basis only and not as a class action, consolidated action, or representative proceeding.

To the fullest extent permitted by law, you waive any right to participate in a class, collective, or representative action, including class-wide arbitration or private attorney general actions.

If any court or arbitrator determines that the class action waiver set forth in this section is unenforceable, then the arbitration provision in Section 22 shall be deemed null and void, and the dispute shall proceed in the state or federal courts located in Denver, Colorado.

The Platform may operate in connection with other websites, applications, or services operated by the same owners or affiliated entities (collectively, “Affiliated Platforms”). These Affiliated Platforms may include, but are not limited to, the RE-Quest platform and the MyAgentNavigator platform, which provide complementary services within the real estate ecosystem.

Participation in any cross-platform functionality is voluntary. If users choose to link accounts or utilize services across Affiliated Platforms, they acknowledge and agree that certain information may be shared between those platforms in accordance with the applicable Privacy Policies.

Each platform operates as a separate service with its own terms, policies, and functionality. Use of an Affiliated Platform may be subject to additional terms of service and privacy policies that govern that specific platform.

Neither platform guarantees the availability, functionality, or accuracy of services provided by any Affiliated Platform. Users acknowledge that interactions, services, or relationships that occur on one platform are governed solely by the terms applicable to that platform.

To the fullest extent permitted by law, each platform disclaims any responsibility or liability for services, actions, content, or interactions occurring on an Affiliated Platform, even if access to that platform is provided through cross-platform features or shared accounts.
